NEW HAVEN, Conn. -- A Boston Red Sox fan who was harassed and stabbed through the neck by a New York Yankees fan at a restaurant in 2010 has been awarded $4.3 million by a jury.
The jury in New Haven reached the verdict Thursday in favor of Monte Freire and against the restaurant, U.S.S. Chowder Pot III, in Branford, attorneys for both sides said. Bartenders ignored warnings that the Yankees fan was harassing fellow patrons and trying to start a fight and continued to serve him alcohol, said attorney Timothy Pothin, representing Freire.
"We're grateful that the jury was very attentive. They understood our case and held the Chowder Pot responsible for its employees' negligence," Pothin said. "Perhaps this will provide a lesson to other bars and nightclubs in our community and their insurance carriers who continue to maintain untenable positions in cases of clear negligence."
Freire, 45, suffered life-altering injuries, including a brain injury, a stroke, impaired speech and vision and severe scarring, Pothin said.
The Yankees fan, John Mayor, was convicted of assault and is serving a 10-year prison sentence.
Mayor told Freire, of Nashua, N.H., and his friends that based on their accents he believed they were Red Sox fans and declared it was Yankees territory and they weren't welcome, Pothin said. Mayor continued to harass them before the unprovoked attack, he said.
The restaurant's attorney, Jan Trendowski, said he'll appeal. He said the complaint was that the patron was arguing about a baseball game and the bartender looked over at the patron, who was sitting quietly, and decided to monitor the situation.
"They warned the bartender the guy was acting like a jerk," Trendowski said. "How they make the jump from jerk to stabbing, that's the real issue here. What is the sane response to the insane situation? If you don't know why he stabbed him how can you possibly say that something contributed to it?"
A message left with Mayor's attorney on Thursday wasn't immediately returned.



It's a GAME PEOPLE. One that you have no financial stake in. I love my baseball, and like and understand a good rivalry. But come on people. Like Prince once famously said - "Act your age, not your shoe size".

It is unfortunate that every fan base has a plethora of complete morons that do not really understand what a rivalry is.... It is also sad that many idiots can't hold their liquor...

I just read that the SF fan that got mauled by the LA fans last year just finally went home...

There are certainly some other demons lurking behind the scenes for people that feel the need to fight other fans. I'm a die hard Devils fan, had season tickets, saw many fights in the stands and all I could think was "wow, I would never go to jail for a bunch of millionaire athletes that don't know I exist". Can't people just be happy drunks, or you know, just not get drunk?

Depending on what actually went down at the bar, I'm not sure they should bear liability. If he was talking some shit about baseball, that's not a reason to kick someone out, or evidence that they will stab someone in the neck.

I hate these stories, not because they happen but because we identify the teams that they are fans of... He did not attack the man because the other guy was a red sox fan, he attacked the guy because he is a crazy person... The team was just his excuse...

I think the bar's liability came from continuing to serve a guy who was drunk and belligerent.

I hate drunks. For this reason alone marijuana needs to be legal. More pot smoking, less drinking means less violence in America.

This is why you don't rely/expect other people to get you out of trouble, especially pussy bartenders. Either take the offensive and kick the guys ass once it's obvious he isn't going to stop, or if you can't fight, leave the bar. If he follows you use your cell phone to call the cops.
