A third charge was dropped. There isn't any criminal code for waving arms in front of an officer's face.

/unless the arms was a Smith and Wesson.

One of the charges has to be impersonating a human being.

According to the report, the criminal mischief charge was for Avery allegedly throwing objects at passing vehicles.

He once threw himself to the ice at a passing Jagr.
