And on top of that the physical evidence produced by a r*pe kit can often be explained away by claiming it was consensual. The only way that doesn’t work is if there is physical evidence of violence.And? We only allow a vigorous defense for crimes that aren't uncomfortable for the alleged victim?
The problem with r*pe/sexual assault cases is that, if I recall the statistics correctly, the majority of rapes aren't the followed home/random attack variety. Most often, it is a date r*pe situation or at least a situation where the accused is someone the victim knows. I'd wager that also has a fair bit to do with why these crimes are underreported.
The whole thing is just incredibly difficult...even the r*pe exam which is necessary to get evidence to convict someone can leave a woman feeling vulnerable, if not downright demeaned. She's already been raped and from what I have heard, the exam can almost feel like a second r*pe. Especially, since it needs to happen pretty quickly afterwards for the best chance to get evidence when all she probably wants is to get home and take a shower to wash it all off.
