I can definitely see how Miller's stick swing would have been missed by the official at full speed, because I'll admit that until I saw the replay, I didn't catch it either, thinking that the stick whipped around with his body momentum and he was probably watching Lucic moreso than Miller at that point under the expectation that someone was going to jump him. They've got a chance to address it now after the fact.
I'm not sure exactly how the NHL suspension rules work. Can they issue a suspension to Miller and have it come out as "timed served" since he was injured on the play and will miss at least a couple games anyhow, or would any suspension have to be added to the end of the injury time?
But the intent factor for Lucic is pretty obvious, given that he makes zero effort whatsoever to avoid the contact. He doesn't pull up, try to stop, swerve, or anything else.
