Public officials and celebraties have a high burden of proof when it comes to these defamation lawsuits. The lawsuit will also also TMZ to start digging into Kaepernick's personal life and in the end the publicity from a lawsuit will end up helping TMZ more than hurting it.

No they stated Kap was being investigated for sexual harassment. After the police came out and said it wasn't true, TMZ stood by their story. Now it appears that A- Kap wasn't even there, B- it was never a sexual assault case. They drug his name through the mud and damaged his reputation with a false report that they refused to retract. He has a case.

Truth is a defense to defamation, but that doesn't mean falsity is proof of it, just a factor. As someone else said, the standards are raised for celebrities. Simple negligence wouldn't do. Can he prove their was worse? (Recklessness needs a standard and degree.)

Doesn't sound like there is much to gain for Kaepernick by suing TMZ. As someone stated, the standard is high, as Kaep is a public figure. Suing them will only keep Kaep in the spotlight for non-football reasons, which no one wants. Plus, he's gonna get paid big time soon, anyway, so he doesn't need the money.

I believe thier first article said he was under investigation for sexual assault in bold letters. Yes, later they changed it. Like a day later,but the first headline did say it. It's why Kap had a rant tweet out the following day.

I got pissed when Hammer, Moski, and a couple other mods came over here talking shit - not realizing how ridiculous they were at the time. I am not bothered by it. As long as it stays on the General Board I can choose to avoid it. At first I was just reading it, until it got so ridiculous I decided to stop reading it. It is best to ignore (I should take my own advice!) I had no idea that Misko was the only Mod for the 9ers' site. They have new thread going....I would just say let them have their fun and ignore. It is the off season and the 9ers players are in the spotlight for a while until everything comes to light. My main concern is Aldon...the guy just won't quit with the stupid. I doubt the 9ers carry the option for the 5th year with him....sad.

Maybe false light, rather than defamation, is the best cause of action, but still, it's hardly worth it for Kaep to sue them.

Being a mod doesn't exempt him from being a troll. Let him, Hammer, and the SEA fans jerk off to those memes on the GB so we can continue to have a relatively troll free discussion on our board about the same topic.
