Now that I think about it some more. Why is Giroux having a hearing if OV did not. OV clearly left his feet on that hit. To me they are pretty damn close to the same thing. Just so happenes OV did not get the guys head.
Both its had bad intentions. Both players should be subject to the same thing.

For what it's worth, I don't think it was intentional. I think Giroux expected Zubris to skate a little harder and he would have shouldered him right in the chest. That said, Zubris DIDN'T skate harder, and Giroux DIDN'T get him in the chest, and the onus is on Giroux to make the safe play, so intentional or not it still deserves attention from the league.
The borderline lateness doesn't help his case either.
Nor does the fact that he was yelling at the ref 20 seconds earlier, which wouldn't lend a lot of credibility to an argument that it wasn't a retaliation hit.
Possibly the same excuse that Neal gave for not getting anything for the hit on Couturier?
OV was trying to play the puck in his skates and possibly convinced the league that he didn't see Girardi and jumped to avoid him/minimize the impact.
(Don't buy it personally, but the league bought it for Neal too).
