We'll see how it plays out, but putting money up on an event of any kind in which the outcome is not predetermined, is gambling. That's why it's called gambling.

It still amazes me that horse racing isn't considered as such, unless it's fixed like the NFL, right Kramer1?

You aren't putting money up on an event. The outcome of the event is meaningless.

True, but it still holds that the outcome (statistics) are not predetermined, and wagering on that is gambling.

If two buddies got together and bet that a player would total X amount of yards, everyone would consider that a bet, and a bet is, pretty much gambling, no?

I'm neither for, nor against the rulings as I don't participate. I just find it interesting.

dude, its gambling

you're betting money on a players projected performance. some skill involved (matchups, research, etc), but mostly just guessing...i.e gambling.

its a money grab for states that want in.

It has to do with whether or not what you're participating in is a game of skill or a game of luck. Fantasy football is a game of skill so it makes sense not to cover ban it based on whether or not it's gambling. But the same can be said about poker but they call it a game of chance. But the bottom line is that they're protecting local establishments that they have an existing tax stream with. And it's actually a felony to play online poker in the state of Washington, which is a complete joke.

I definitely think it's gambling. I was just pointing out a big difference (in my mind at least) between fantasy sports and sports betting.

Here is Fanduel's response by the way. I love the last sentence.

The New York Attorney General has sent a letter asking for daily fantasy operators, like FanDuel, to cease and desist operations in the State of New York.

“Fantasy sports is a game of skill and legal under New York State law. This is a politician telling hundreds of thousands of New Yorkers they are not allowed to play a game they love and share with friends, family, coworkers and players across the country. The game has been played — legally — in New York for years and years, but after the Attorney General realized he could now get himself some press coverage, he decided a game that has been around for a long, long time is suddenly now not legal. We have operated openly and lawfully in New York for several years. The only thing that changed today is the Attorney General’s mind.”

Not sure that anyone can, with all honestly, say that this kind of betting is based on skill. Good guys have bad days. Bad guys have good days. Guys like Rodgers go out and toss 77 yards in a game, as an Elite level QB. I'm sure they'll talk about matchups and playing %, but that's still no different than playing basic strategy in blackjack or poker.

I definitely disagree a bit. Skilled DFS players certainly would not have had Aaron Rodgers as their QB playing against Denver. That outcome wasn't bad luck.

Agree, and probably a poor example. But, the fact remains that even playing to the % is something that basic gamblers do in any casino.

has an outcome that reflects the relative knowledge of the participants, or their skill at physical reaction or physical manipulation (but not chance), and, in the case of a fantasy or simulation sports game, has an outcome that is determined predominantly by accumulated statistical results of sporting events…

A lot of it determines on what the "game" is. If you look at poker and one hand, then it has a lot more to do with chance than it does with skill. But if you look long term the better player is going to come out ahead. Same is true of fantasy football.

That's really not the case. If it's fantasy, then Aaron Rodgers is obviously going to do better than someone like Kaep. Everybody has off games, but somebody would have to be clueless to take one over the other. It's an extreme case but it illustrates that knowledge is a factor in the outcome. Then there's things like the IR, how the teams stack up against each other, whether a team is coming off of a bye, home performance vs. away, ...

If you chop it up to each particular weekend being an event then it would seem to lean more towards the luck end of the spectrum (I wouldn't call it half way, but luck would have more of an influence), but long term like the course of the season would lean more towards the skill.

But like I said, the ones that scream the loudest tend to be the ones that have local gaming interests.

Blackjack isn't gambling, it's stupidity. They built one of the most ridiculous cities in the world (Las Vegas) based on the pretty thin edge that the house gets.
