As much as it seems it should be neither the UNC nor Penn State situations fell within the purview of the NCAA. UNC received discipline from their accreditation organization and Penn State was penalized civilly.

A lot of people will disagree with you about UNC's academic fraud not falling under the NCAA's jurisdiction. They essentially created a phony major and program of studies to make it easier for their student athletes to maintain academic eligibility.

Common sense says they created a fake course of studies specifically for their student-athletes. The fact that they ensnared non-athletic students into it just shows that they knew exactly what they were doing.
