He'd hurt the Yankees worse by not retiring.
If he serves the full year and a half suspension, they'll still owe him north of $50M when he comes back.

If they made it so you had to be activated to serve. Then Teams would immediately activate their Injured players that got 50 games, regardless if the player was actually healthy or not.
