FALL RIVER — Superior Court Judge E. Susan Garsh reversed her ruling from last week and said Monday that she will allow prosecutors to question Odin Lloyd’s sister about text messages that she and Lloyd exchanged minutes before he was shot dead in June 2013.Jurors will hear testimony that Lloyd and his sister, Shaquilla Thibou, exchanged four text messages between 3:07 a.m. and 3:23 a.m. on June 17, 2013. However, the jury will not learn the messages’ contents, which Garsh previously suppressed on grounds that they were prejudicial to Aaron Hernandez, the former New England Patriots star tight end who is on trial for Lloyd’s murder.

don't forget a few text messages between Lloyd and his sister saying he was with Hernandez not long before he was killed


Minutes before the alleged murder took place, Lloyd had this ominous text message conversation with his sister:
Odin Lloyd (3:07 a.m.): "Did you see who I am with?"
[no response]
Odin Lloyd (3:11 a.m.): "Hello?"
Sister (3:19 a.m.): "My was phone dead. Who?"
Odin Lloyd (3:22 a.m.): "NFL."
Odin Lloyd (3:23 a.m.): "Just so you know."

I think it was. There's still a lot of evidence to link Hernandez to the scene. They just can't quite prove he pulled the trigger. I think there's a lot of evidence to convict him for some serious time.

I don't think they have to prove he pulled the trigger though to convict him of murder. All those present can be convicted of murder as they were all a part of it even if they were not the ones to pull the trigger. that is why honestly I am a bit shocked that his friends haven't turned on him as they could be shown some leniency if they were willing to say Hernandez was the one to pull the trigger.

Supposedly there were 4 people in the car when Lloyd was murdered. Two of Hernandez's Bristol Boys and Hernandez. The Bristol Boys recanted their original deposition and were never called to the stand as witnesses. The prosecution has been unable to put Hernandez at the scene of the murder. It's all "supposed", no witnesses, no physical evidence. This is why there is so much circumstantial evidence being introduced.

We can all have an opinion and believe whatever we want, but the jury has to make their decision based on evidence. I have no idea how good Hernandez's attorneys are regarding their skill at delivering a final argument in a murder case, I have to assume that they're pretty good. Unless something breaks between now and final arguments, all they have to do is convince the jury of 'reasonable doubt' and Hernandez could get a much less sentence...........

Just remember OJ and the girl in Florida about 18 months ago, or even George Zimmerman. Juries today don't like to convict anyone that the prosecution hasn't proven beyond a reasonable doubt.

I think they have bullets and his dna in the car and at the scene? They have film of him with a gun. in the car etc.

So there seems to be a lot of evidence that he was there at the scene of the crime. Let's see what the defense offers in terms of an alternative to him "participating" at some level.

Maybe he won't get the 1st degree but he's getting away with some token time spent in jail. IMO of course...

Hernandez shot a guy in the face in Florida and basically got away with it. He came extremely close to killing him but the guy lost an eye.

Most of us believe he put one into Lloyd and beyond that he will stand trial for the deaths of two other guys in Boston in 2013.

Seriously? This guy really needs to be locked up.

murder in the first degree requires a higher threshold to get that conviction which the prosecution doesn't have but there is enough circumstantial evidence for a lower charge of murder.

The guy he shot in the face in Florida testified for the prosecution yesterday and the defense was starting in on him when court was adjourned for the day. The defense immediately started making him answer questions about his shady past involving drugs and guns. Hernandez shot him for sure. He never filed a complaint with the police...why? He took $100,000 payoff from Hernandez, why?? If someone blew my eye out and nearly killed me, I'd have his ass in the slammer as fast as I could open my other eye. Settlement? My eyes are worth more than $200,000. He's a shitbag and the defense is going to tear him to shreds. I can't understand why the prosecution would put a guy like this on the stand knowing that the defense will expose everything he's ever done illegally or immorally.

Like I had previously posted, the prosecutors more than proved the case for murder. Turns out I was right.

A first-degree murder conviction in Mass. automatically triggers an appeal to the Supreme Judicial Court. A date for the Hernandez appeal wasn't immediately set.

Did not know this. Hopefully the Court finds everything was done to the letter of the law and there are no grounds for a reversal.

The radio heads, with all of their legal knowledge and experience have been discussing all of the appeal positions that the defense might take. The funniest is "Legal incompetitence". Apparently one of the defense attorneys stated in his closing argument that Hernandez WAS at the murder scene with Lloyd but was sleeping in the car when he was shot.........

They should appeal on Defendant's incompetence for continuing to use his home security system as prosecution evidence gathering and doing stupid shit on video, like carrying a .45 caliber hand gun in front of a camera and filming his finace bagging a huge bag of stuff in front of the camera........you know, the one she drove to a dumpster. The dumpster location that she just cannot remember.

The auto appeal is to prevent multiple appeals that can take years and millions of taxpayer dollars to complete.

I'm still ballistic about a guy here in Manchester, NH who shot a cop in the back of the head a day after openly telling about 20 people he was going to "pop a cop". He's was 21, convicted of murder and sentenced to death. He defense cost NH taxpayers $2.5M. He still has the same team of attorneys and we've spent another $1.5M on his appeals of the death penalty as cruel. They expect we'll pay another $5M to get the sentence overturned to life w/o parole. That's bullshit.....................
