Why the fuck should it be up to the business? Those laws are in place because second hand smoke is dangerous and you can't subject your employees to something that is a known danger.

It has nothing at all to do with the customers or the business.

It's about the people who *have* to be in that space as their job and them inhaling second hand smoke against their wishes.

And I say this as a recent non-smoker (hey, it's been 4 days!).

Then perhaps they shouldn't be in that job, or the place could be required to allow employees to refuse to serve to that area. I guarantee there would be enough people willing to work under those conditions to still fill the jobs. There are a lot of smokers in America, and I can't imagine very many of them are adamantly opposed to being around second-hand smoke.

Or perhaps restaurants could be allowed to apply for a license. If they are not a "family restaurant" for example, they could get smoking rooms. Then not every restaurant would have smoking areas, which would reduce the number of employees who have to work in those areas.

But essentially, if the employees know what they're getting themselves into, it shouldn't be a huge issue anyway, because it's ultimately their freedom to take or not take that job. Coal miners are exposed to some pretty crappy situations, but they still take the job. A lot of factory workers are the same. Heck, as a chemist I recognize that I'm going to be around a lot of carcinogens in my lifetime, but I recognize that risk and want to do the job anyway.

Do you think that usually people working in bars and restaurants have a lot of employment options? Dishwashers, hostesses, bus boys, etc? It's a pretty low-level job to be working like that in the service industry.

There are actually ways around the laws though. For example, if the employees of the bar are all part-owners, they could make the decision to allow smoking. There are some smoking only bars that I've been to. And you know what? Most people stay out of them and of the three I know of, all three shut down. Because smoking is getting less and less common. And even though I smoked, I didn't want to make my friends who didn't, have to deal with the smell and the air. I also didn't like to be around it either.

Chris, you would like a visit to San Francisco. I feel like beer is a big business here. Lots of breweries. Lots of beer-only specialty bars. My friend owns a bar that sells only beer. Something like 200 different kinds?

One of my favorite breweries is based out of San Francisco: Anchor Steam. I love their lager because it's so much like an ale, and their porter and bock are also delicious. They serve them at a bar in Meadville. Good stuff.

And I would love to visit a place that serves 200 different kinds of beer. There are 60 at a time at the place I go to here, and they rotate them constantly for the seasons and what not. I've had close to 25 different kinds there in less than a year. Once I reach 25 (which I plan to next weekend, because I can't go out this weekend due to some responsibilities), I'll get my name on a plaque. :)

Good call. Going to bars did in my one friend who was trying to quit because being around the smoke just made him want to smoke more.

I understand all of that, and in your area it's probably a wise choice to not have smoking in most places because that's not their clientele, but in PA, or at least in southwest PA, something like 50% of people smoke. There are places that have lost a lot of business due to the laws.
