Sounds like the Vegas Golden Knights might have to make a name change soon already. Because of a trademark issue.

They were also told they couldn't use another variation of Knights because of the Army or something. Black Knights maybe?

Yeah, I think this is correct. And even the "Golden" Knights is something related to the Army as well. It's the name of their parachute team or something. I hear that the Golden Knights' owner has also trademarked a website name for SandKnights.com as a "just in case". So it sounds like if they had to change their name it would be to the "Sand Knights", which wouldn't even require a change of colors or logos or anything if they didn't want to.

In trademark law, "consumer confusion" drives most suits brought against entities accused of trademark infringement. Unlike copyright law where ownership is somewhat intrinsic, trademark applies only if you put the mark into business practice and the protection is not absolute. For example, I could register the Golden Knight Buffet as a restaurant in Washington DC. If I never open it up, a judge would toss out a suit I would bring against the Vegas Golden Knights because I haven't put the trademark to use. Even if I did open up the buffet, a judge would likely think a restaurant across the country is unlikely to be assumed by consumers to have any connection with a professional hockey team. Survey data of consumers is often a key piece of evidence in these types of cases.

You will note the Vegas response includes "dispute... confusion is likely." This is not an accident and the tongue and cheek nature of parachute team comment is meant to drive home this point.

A quick look at the USPTO Office site shows 29 trademarks registered with the term "Golden Knight" in them. Trademarks often coexist, especially since most businesses are local or regional and register their marks with the Secretary of State.

Legal Forecast: Vegas ain't changing their name b/c the Army will find proving consumer confusion very difficult. If Vegas is smart, they are already having a survey group craft and execute a survey to prove this.
