And if he's truly a stone drunk alcoholic he might not have seemed as drunk as most people would at .27

That's pretty damned high though.

Bars will often lose these kind of cases though

I know they do, and that is dumb as hell. The bar is not making you drive. Honestly if you are driving drunk I just hope your accident happens in a spot that only hurts you.

Holding bars accountable has had a huge effect upon driving hammered though.

most bars are so damn busy (we are a country of fucking drunks) that its way too much to put on a 23 year old trying to please 100 fucking drunks that he/she can't keep count of everyone.

the only way to track is make everyone keep a tab but then stop them at 2 or 3????

Holding Bars accountable for drunk driving has been going on for decades. This is nothing new.

The interesting facts in this case:

  • Tiger owns the bar and his girlfriend is the general manager.
  • The guy who died was in another accident recently and was going to AA.
  • It's alleged that Tiger & his girlfriend both knew of this.
  • It's alleged that Tiger & his girlfriend and the kid that died were drinking at the restaurant a few days before the accident.

If all true ...things could get sticky for Tiger & his girlfriend.

Sticky? Well perhaps in the fact that they will have to cough up some $$ but probably not more than that. A lot of vague details in this story. They are making it sound like Tiger & his girlfriend were forcing drinks on the guy & that he was acting like Otis on the old Andy Griffith show. Most likely that was far from the case. Tiger may have only seen him for a few minutes & the deceased may have appeared fine & not even drinking much (& that was not during the nt he died).

This is fodder for POS outlets like MSNBC & CNN. They will not doubt milk this for all that they can especially after Trump recently awarded Tiger at the WH.

Most functioning alcoholics rarely ever get below .10, and you'd never be the wiser. It's actually really sad when you think about it.

Not a fireable offense.... and had the establishment fired him, he'd be facing other discriminatory issues.

Right, clearly the bar was in support of this employee by letting him keep his job while he went to AA.
But then how in the heck does that same bar serve him Alcohol to a .275? An employee with a known drinking problem.

Again, if all true ..all of that prior knowledge of the employee and his issues in my eye's makes this bar more liable then if this happened to some Joe who walked in off the street.

I'm just saying that the .27 isn't all that high for an alcoholic, considering where they're starting from.

Tiger, girlfriend named in wrongful death lawsuit

I get being sad because your kid died, but he drank himself to a .275 while at work then got behind the wheel. At what point does personal accountability come into play?

And if he's truly a stone drunk alcoholic he might not have seemed as drunk as most people would at .27

Florida law:

768.125 Liability for injury or damage resulting from intoxication.—A person who sells or furnishes alcoholic beverages to a person of lawful drinking age shall not thereby become liable for injury or damage caused by or resulting from the intoxication of such person, except that a person who willfully and unlawfully sells or furnishes alcoholic beverages to a person who is not of lawful drinking age or who knowingly serves a person habitually addicted to the use of any or all alcoholic beverages may become liable for injury or damage caused by or resulting from the intoxication of such minor or person.

"Florida does not hold an establishment, vendor or social host responsible for serving alcohol to a person who already appears to be intoxicated. It only allows for liability if alcohol is served to a known “habitually addicted” person or a minor."

Which is why they allege that Tiger and his squeeze knew the dude was in AA, and they were dinking with him. Not right before the crash, but they allowed him to be served at their restaurant when he did crash.
