"I think when anybody sends a picture they only expect it to be received by the person that they sent it to and nobody else," Miranda said.

I think there is a difference between "oh, damn it, my ex is an asshole, I should have expected that" and being fired for taking a private photo.

The latter should have never happened. In particular, the school administrator in the hearing should NOT have displayed the photo during an administrative hearing. That is absurd behavior.

A teacher dancing topless in a public bar? Sure, fireable. Sending a private picture? No...fucking...way.

She will sue. She will win... big.

I have no problem with everything you say, I just think the naivete is just stupidity. That's all...I'm all for topless women. Hell, in Rochester, NY, where I was growing up, there were annual protests by women wanting to go topless in the park like us guys who were playing ultimate frisbee in the park, topless.

And yes, dudes are a-holes and shouldn't be sharing naked pics, but should it really be a crime?

Agreed. I think dehumanizing other people for revenge is generally shitty behavior and should be punishable. Especially since many of us make mistakes when we are young and those shouldn't haunt our personal and professional lives indefinitely. I generally think these types of crimes should be better defined and that we should decriminalize many of the nonviolent, self-inflicting drug crimes that overwhelm our system (and which the privatized prison systems depend on, because fuck them).

As of 2019, 41 states and the District of Columbia have specific laws outlawing distribution of revenge ****. However, revenge **** laws are still relatively new and the laws are continuing to develop. In order to be guilty of this crime in most states, the distributor must be sending out pictures or a video that are considered sexual in nature, such as showing the victim's intimate body parts or engaging in a sexual act. Simply posting an unflattering picture of your ex in a bathing suit is not pornographic, absent any other circumstances, such as the victim's genitalia being visible.

Prohibited Actions

While each state has different laws, most generally define the crime of revenge **** as any person, with the intent to harass or annoy another who:

  • Publishes or distributes electronic or printed photographs, pictures, or films that
  • Show the genitals, anus, or female breast of the other person, or
  • Depicts that person engaged in a sexual act.

They should be assisting in investigating whether or not the male teacher was responsibility for it's dissemination and helping the authorities with finding out if he is guilty of distributing illicit materials to minors. He may not be. Someone might have lifted it from him. He's lucky he's in one of the 9 states that don't have a revenge pron law.

While they are at it, suspend the administrator who fired the teacher and investigate if he should be fired.

If that school system has decent people in it, they'll do that. If they had decent counsel, they would have done that beforehand to avoid a law suit.

This. There has been at least one case where a kid took a teacher's phone, got into it and found a nude (and the nude was her documenting a bruise from an accident) and sent it to himself and shared it around the school.

The kid broke several wire laws, invaded her privacy and the photo was never transmitted anywhere by her. Nothing happened to the kid and she lost her job (although she did make some cash in the lawsuit). It was the same "role model" bullshit.

Rules about this stuff are fucking caveman era.


And that's without going into the puritan type little thinking that leads the powers that be to be so fucking afraid of tits in the first place.

I'm not down with the Puritanism, but I have always found it weird that some women wear work clothes that shows substantial cleavage. Just cover it up at work (both sexes) is my preference.

I always joke with people that it's the equivalent of if guys had pants with two holes in them where you could just see a LITTLE BIT of the testicles. Not the whole things! That's indecent. But just a little peak. ;)

Just enough to get a sense of it... and then you look away!!
