Talbot didn't have possession, Ovechkin skated directly over the puck to hit him. While Talbot was certainly NEAR the puck, he didn't have it.
I'll say it could have gone either way. Was still a solid hit, and if they hadn't been in the middle of a 4 minute PP or if the hit had been on, say, Giroux, I'd say it would have been worth it.
