ESPN will have no choice but to fire him. He avoided jail time on the DV charge if he did 500 hours community service and stayed out of trouble for one year. It hasn't been a year so he is probably going to do some time.

Last summer, Barnaby pleaded guilty to reduced misdemeanor charges following an incident at his estranged wife's home in which he damaged a garage door.

Under the agreement, the charges were to be dismissed if he stayed out of trouble for a year. State Supreme Court Justice Deborah A. Haendiges had ordered Barnaby to perform 500 hours of community service and to continue anger management counseling.

Haendiges also issued court orders of protection barring him from "offensive" conduct against his estranged wife and directing him to stay away from her boyfriend.

Barnaby originally had been charged with felony criminal mischief, criminal contempt, criminal trespass, harassment and aggravated harassment following the domestic disturbance on May 13 at his former residence in Getzville.
