It should have been 4th and 2 or 3 and the 49ers would have kicked a field goal and would have not got the TD. The NFL head ref verified this fact

Just because he has an open hand doesn't mean it isn't a punch. Go watch in real time, he hits Staley. That is an automatic ejection. And if you think he was already in the air you are kidding yourself.

1. it was a bit late and he was it the air and couldn't stop. He launched himself into the air well after Kap went out of bounds, grabbed him around his neck and tackled him.

2. it wasnt the NFL head ref, it was Mike Pereira a former Vice President of Officiating working for fox, big difference.
