Can anyone explain why he has no chance of getting suspended when he's obviously doping again? Doesn't make much sense to me.....

On a side note.... When will this guy go away? He's 40.... Obviously doing well because of his PED's. this year he's 14-3 and I bet Oakland would be behind us in the division if it wasn't for him. Watching fat shit pitch in the World Series seems like a joke, but a real possibility lol

Bascially the reason comes down to double jeopardy, that is the argument could be made that he is being tried or punished for the same crime or offense twice. Since he was suspended last year for a positive test, like Melky, and the Biogenesis stuff is also from last season, it would mean that he would be being punished for it again. Good side note though... I say give him another test pronto.

It all comes down to when MLB found out about Biogenesis

Bartolo was suspended for getting caught using the drugs he got from Biogenesis... he's named in those documents obviously (same with Melky & Grandal), so being named in the documents does nothing, they already know they used PEDs due to the failed drug test, as far as this season, they can't prove any sort of link b/c he hasn't failed a drug test and there is no link to any other clinic (all they have is the Biogenesis documents and the failed drug test from the Biogenesis goods, and which he's already served for)

Everyone else named in the documents is assumed to have used these drugs, and I'm sure there has been pretty open dialogue between all players involved, except Braun, hence the 65 gamer

The only way anyone fights this is if they truly did not use PEDs and are willing to go through that long drawn out process and potentially longer suspension, when they probably lose, a guy like Cruz with impending free agency has tons to lose if he appeals b/c it impacts his impending free agency... hence the probably gonna take the handed down suspension

No that means had he failed a drug test last year from his Biogenesis goods and had been suspended, then he'd be getting a pass as well, any further failed tests will probably result in a 100 gamer

The only way he gets another suspension is if he was questioned last year about the source of his PEDs and lied.

No, because that would be a new offense. In Colon's case it he would be punished for the same offense twice, which is double jeopardy... something that is forbade by the 5th amendment.

He's obviously got his timing for the PED's down this year, I don't believe he's not using.
I should have saved the MLB link to the fairly recent game he pitched. He was pulled, they were ahead...and he LITTERALLY walked right from the field to the dugout and LEFT, as in....I'm out of the park, as in, they can only test at the park

I was already pretty suspicious, and watching that nailed it for me. What pitcher leaves the game that's not hurt before it's over?
