Either the control tower by not directing the chopper properly, or the pilot.

Based on the info so far there is a high probability this was pilot error or mechanical failure. Whether flying VFR or SVFR, it is the pilots responsibility to stay out of the clouds and keep visual contact with the ground. That's not hard to do in a helicopter.
I think ATC is in the clear on this one.

Read this pilot had some special privilege to fly in foggy weather. He dropped the ball yesterday and it caused him his life and 8 others. Seems like he didn't listen to air traffic control either
