Yes, they do and the University has been doing it more often since that policy change. There is no merit to sue and Gibbons couldn't prove his innocence because it was a he said she said. Basically, under the new policy you just have to be accused of a sexual assault and if there's no evidence to prove your innocence, they can chuck you out of the school.
That's not how the American legal system works.

This isn't the American legal system. He is not being convicted of a crime. He is being kicked out of school because he violated the school's terms of ethics; which is not subject to the same level of proof.

They're literally the opposite of the American legal system, in fact: Guilty until (unless) proven innocent. Regardless of media attention, this is a disgusting rule.

"Solving" cases...ha. This has to do with Universities trying to cover their own asses and use a very possibly innocent student as the scapegoat. That makes me fucking sick.

I haven't heard of anything like that at OSU, but I also haven't really heard of that many r*pe cases that have come out and been big news.
Here's the policy, the bolded is part of the change. All the University has to determine is a "more likely than not" standard now, rather than actually proving guilt. So when they re-looked at the Gibbons case, all they had to say was it was probably 51% likely that he did it compared to 49% likely that he didn't. Which is drastically different than it was before where you guilt had to be proven and not just "likely".

"A report of sexual misconduct will be reviewed, and if deemed appropriate, investigated by the Title IX Coordinator or designee. In the interest of privacy, investigations will not involve a hearing or require that participants meet together. If the evidence supports (based on “a more likely than not” standard) a finding of responsibility, the matter will proceed to the sanctioning process"

And the discussion is about suing the university for kicking him out. Would the lawsuit be held in a university court or in a county/state court house?

Of course this could go to a court system but even then, the Universities policy is not illegal. You do not have a right to go to a University and must follow extra-ordinary rules, beyond even that of what the law requires, to stay. Is it illegal for a University to have a "more than likely" standard and so far the answer has been no. On top of that, Gibbons would have spent a shit ton of money he didn't have fighting such a policy and no one's going to chip in to support an alleged sexual assaulter.

Not if he is guilty and there was a cover up to keep him there by the athletic department. If he was innocent and there was no evidence there are some that might help like the ACLU. However that wont happen as the university did what the athletic department should have done to him and Lewan.

He had standing to conduct a full investigation and standing to hold Lewan accountable for his threats. They chose to do nothing to either. Go football!!

Well they lost Tebow, that had a lot to do with it.

The talent is there no doubt so if they regress is it Urban? Hard to imagine Ohio St losing 5 games but I guess you never know it happened to Alabama to an extent in 2010 but Saban like always comes back very strong. Oklahoma will be a tough mental test for the majority of this young team.
