The NFLPA would have a hard time trying to defend Rice in this situation. It would make them look really bad.

Doesn't this seem far-fetched? The video was rumored to exist back when the first one was released. You'd figure with the NFL money they would have either seen the video or verified that one did not exist. Maybe they just didn't pay enough to keep it from going public.
