I'm not sure if it's their job or not to hand over that tape. That's a tough one - it's a kind of like hearsay since it's not their tape, etc. In their position, I would have just b/c it doesn't hurt to go to the police and say "you might want to look into this," but I don't think it's a clear cut case either.

What I don't understand is this - why didn't Bobbie Davis just take it to the police?!?

The tape does not offer conclusive evidence of any wrong doing with a minor or that anything that transpired was not consentual. (to my understadning, I have heard clips repeatedly but I don't know if I have heard the entire thing or not.)

A Syracuse newspaper had the same tape and also didn't release it to the police.

The accuser went to the police and they dismissed his claim until another party could coroborate (sp?) the charges (which was when the story finally broke).

The story, in my opinion, is completely unfounded and trashes ESPN to get hits on its site. Terrible "journalism".

That's not really the point though. I think this is a somewhat gray area (or a "grey area" for our Canadian friends). If I say to DaBolts, I just saw Jeff Sly rob a bank, should DaBolts call the police? He can't know what I'm telling him is truthful and there is nothing stopping ME from calling the police as an actual witness/involved party.

Personally, I think it's better to air on the safe side and get others involved.

The safety of a child is clearly more important than some company policy. But there are other considerations here. This is not the same as the Penn State case.

Seems to me that regardless of the factors involved, there is no legitimate reason to not hand this info over to authorities. Had ESPN done so, they certainly would not be held liable for slander or defamation. They aren't releasing the story at the time the tape was received, so it has nothing to do with journalistic integrity. Moreover, why would they need a second witness to corroborate the story in order to turn this info over to authorities? They need a second witness if they plan to run the story. That point in and of itself should be evidence of their motivation in this case.

But then again I don't work for them and I don't know all that was discussed at the time.
