God damn it, he was at the house when Ray did something to a girl. The worst part he was drinking. I guess we can say bye to him. This kid won't learn. I hope everything is ok when the facts come out but right now not looking good.

Some Advice Aldon lock yourself in a room for a year or 2 and don't get into any trouble.

If there's anyone who's had a "pattern of bad decisions" it's Aldon, but his case is different in that he hasn't been violent or accused of being violent to anyone. However, freaking damn you Aldon, can't you stay out of the news at least for a year, or hell lets work up to it and do at least 6 months?

I definitely don't want to cut him as he hasn't been violent to anyone and let's be real, Aldon would be snapped up by a team as he's walking out of the building if he got cut, but if he goes to jail or receives further punishment from the league like a suspension, then there at least needs to be a something figured out. I don't know what.

Its hard to prove if he was drinking in a house so I don't know if anything will happen but u are right can Smith please stay out of the news for at least 6 months and then try a year.

From what I read it violates his probation if he even goes to a liquor store. The alleged victim says she, McDonald, and Aldon all went to buy vodka and cranberry juice. So I am sure there are cameras in front of the store. But wouldn't they need a warrant of some sort to request video evidence? After all, all this could very well be hearsay what this woman is saying.

Yes they would need a warrant. Also it depends who bought it. If Ray bought it then Smith is fine.

This may sound crazy, but maybe the 49ers should sign him to an extension to lower his 2015 cap number of 9.75 million and open up cap room. Also, structure his contract which allows the team to pull out at any time should he get in trouble.

He really shouldn't even be anywhere around alcohol for his own sake, but he clearly has a big problem with it. He just doesn't get it.

Not to say he actually bought or drank it or that any of that can be proven, but yikes, just stay the fuck home. He won't be released or anything because he is much better than McDonald, but if he get arrested I'd say he's done?

The Niners have tried to back him and stand by him (most likely because he is such an extraordinary talent) but how much is too much? The FO doesn't seem to care if people think they are scummy, so who knows.

Let's see if a motion to revoke probation is brought before we worry too much about this. The court proceedings discussed in the article have to do with Ray's case, not Aldon's. If one is brought, let's hope that the judge sees this as a minor violation.

The problem is that he is under court order not to drink.

I'm going by what was stated in the article posted in the other thread. In a case involving alcohol, the judge can (and I think they often do) make this a condition of probation. Based on the article, it looks like that is what the judge decided to do in Aldon's case.

I am not an attorney, but I suspect they wouldn't necessarily need a warrant. If the police went to the store and asked the store owner to view it, and the store owner voluntarily agreed, probably wouldn't need a warrant. I am not in law enforcement either but unless the police want to see the video as part of Ray Mac investigation, it seems to me they wouldn't go to obtain the video on Aldon, who is potentially violating probation but is not under a criminal investigation.

His agent just denied Aldon was drinking and that he just stopped by McDonald's house and left shortly after that to go to a charity event. Also, per his agent, his probation does NOT prohibit him from drinking, bur rather driving with ANY amount of alcohol in his system. Not sure anything will come of this.

You have to go to prison to be on parole. Aldon is on probation. On parole, he'd already be back in prison just for being around a possible crime.

I'm glad this is the case. It looks like the article posted here got updated and corrected last night. Yesterday, the article stated that he would be in violation of his probation if he drank alcohol.

Lol sorry, I meant probation violation. :doh:

But anyway, hopefully nothing comes of this and it's proven Aldon is innocent. At the end of the day I don't think it can be proven Aldon did drink anything (I know he's allowed to drink, but if he left soon after then he is in violation of probation unless he had someone driving).

Unless Ray McDonald has cameras in his house then that's another story.
