How is an ACC team's game vs pseudo-conference opponent, ND considered OOC? Do gamesd against ND not count in division/CCG reckoning?

How is an ACC team's game vs pseudo-conference opponent, ND considered OOC? Do gamesd against ND not count in division/CCG reckoning?
Can you imagine the shit storm that would happen if games against ND counted and (as an example) FSU ends the season 8-1 with a loss to Clemson and Clemson is 7-1 with a loss to Duke? FSU goes to CCG because of a better win percentage but without ND game Clemson goes.How is an ACC team's game vs pseudo-conference opponent, ND considered OOC?
