Well I've already explained to you that even the NFL isn't making the argument he had anything to do with the deflation of the balls in that case.
Spygate had to do with filming from an unapproved location.
- That does't involve the QB.
- Filming the opposing sidelines wasn't against the rules, and remained such for many years after the ruling. The Patriots were punished for filming from a location that wasn't approved. Following that incident the Patriots, and most NFL teams, continued to film the sidelines of opponents but did so typically from the coaching/press booth of the stadium. (Each stadium is configured different so the location varies based upon the particular stadium. If you come to Gillette I can show you where they film the opposing teams sideline from.)
