As the NCAA answers back at Trinidad Chambliss' preliminary injunction, an attorney on the Ole Miss' quarterback's side dropped a bold statement.

Trying to figure out the NCAA's play in making this announcement now? No question there will be lawsuits. Based on previous experience, I think they may once again be on sketcky legal grounds. Could be a last gasp effort to reassert themselves while Washington's attention is focused elsewhere? Charlie Baker is an old school New England politician, he understands/knows how to game the system.

What do they have to lose? Out of the big meeting at the White House, we quickly realized no one there held them in much regard. With little future otherwise, why not go for it? Show Trump there is still the interest and the drive to navigate this bizarre new reality. Even if they lose a legal challenge, a cogent, well presented arguement in court could earn them a place/niche in Trump's upcoming college sports EO.

My wife is a political consultant, and her company helped produce a “fireside chat” with Charlie Baker and Chris Christie a few months ago where they started talking about all of this. First of all, that Baker and Christie are meeting kinda tells you what regard that people have for the NCAA right now. Christie is pretty irrelevant on the national stage at this point, and that also ran the risk of Baker drawing Trump’s ire because he and Christie despise each other.

Beyond that, this is a lose/lose situation for the NCAA. My father in law is a huge Alabama and South Carolina fan (grew up and lived his whole life in Columbia, so roots for all SCar sports except football when it impacts Alabama) and he parrots talking points that many of his generation do about how the transfer portal and NIL has led to the ruin of college sports. The middle generations have never understood why players couldn’t transfer and use NIL rights to make money off themselves, so they’ve been all for this but maybe with some guardrails. And the younger generation, it’s a reality for them. The NCAA has pretty much everyone despising them, from letting this happen, to losing any sort of institutional control and essentially letting the SEC and B1G become as powerful as they are.

No amount of PR for the NCAA is going to control this. They pushed for the elimination of two transfer windows, and now they are stuck in a tough situation because of it. They’ve been barking up the wrong tree anyway. Their focus should be on fixing the end of season calendar, and they should’ve kept the spring transfer window open.

No way this is going to work. As the attorney the author interviewed points out, state courts can/will rule in favor of individual athletes. Only way to resolve this is a CBA between a players' union and whoever represents the colleges and universities. Somebody ought to be talking to the NFLPA.

Yeah, judges have been quickly shutting down anything that prevents kids from earning money at these schools. I have no doubt they'll throw themselves in front of this as well. Especially since many of these judges seem to be boosters or supporters of the schools in their states. I like them trying but the cat's out of the bag. And one thing they had to keep this under control was making people sit after a transfer and they completely blew it when they got rid of that. Whoever made that move needs to be slapped aside the head.

Chris Christie's a whore that pushes himself onto any political show, panel or discussion he can. I have no idea why people keep putting him on the air but maybe they can't get anyone else with the same credentials...

Great post, but you hit the bullseye in your first sentence. Many, if not most, recent cases against the NCAA have been won using that "they are denying my right to work and support my family argument." Where have we heard that before?

Do you remember OSU giving lunatic RB Maurice Clarett the boot in 2003? He commenced legal action against both OSU (civil for suspending him) and the NFL (antitrust for their age/three years removed from high school draft eligibility rule.) He lost both, but the results of the latter suit (decided on appeal) basically said labor law thumped both antitrust and civil law.

So while Clarett made essentially the same argument challenging the draft being used successfully by college kids currently, he lost. The court said the collective bargaining agreement (CBA) between the league and the players association was binding since the NFLPA represents all current, past, and FUTURE players. The court ruled the labor agreement between the league and the players union was therefore binding on Clarett despite him not being a union member.

We need that level of binding agreement on eligibility and related issues in college sports, or a least football and probably basketball. That will require representatives of both schools and players to hammer out a CBA. Neither side will get everything they want, but if done properly, that binding agreement will preclude kids from filing individual lawsuits concerning eligibility and salaries.

I wouldn’t think that Bob Chesney would know what to really do with an athlete like Gordon, and I like Chesney and think he does well at UCLA. Just isn’t a fit.
