the fact that they don't get protected by working for the schools is silly for me. It's essentially a psuedo govt entity since it's funded by taxpayer intuitions and works for them.
That would require a CBA, and the schools are dead set against it. Precluding unionization and collective bargaining is what the SCORE Act is all about.

Which is common sense since they’re obviously not employees

My point was more they couldn’t sue the school direct so they’re stealing from them indirectly

So are the new schools leaving going to create their own governing body and rules to dictate rules they should follow? You kinda like what the NCAA is? It will be the same with new people and simply be rules catered to those schools. More will join, would be the same thing as before until a gross overhaul is done.

For the same reasons the NCAA is seeking it through legislation like the SCORE and PCS Acts. As The Q pointed out earlier, "....suing the ncaa is just an end around and stealing money from tax payer funded institutions." If the NCAA had had a statutory anti-trust exemption (as in granted by Congress with the weight of law), these whack-a-mole law suits would have never occurred.

You saw what happened when Team Sorsby realized they were looking at going to federal court suing a professional sports league with anti-trust protection and a CBA. Despite the bravado and fist waving, they weakly exited stage left, whimpering as they went.
That's because the NCAA really is a monopoly. If one of the conferences or multiple conferences seceded, it would no longer be a monopoly - nor would they.

no the shakedown is the current set up
No its not. Conferences get TV deals based on the level of fan interest in their product.
and suing effectively a group of taxpayer institutions they couldn't otherwise by brats who already used up all their eligibliity
Those taxpayer institutions run their sports programs as businesses (often they are set up as separate entities).

They would have to.

Not really. A big problem with it is the small frye outnumber the major programs and can thus pass rules that harm them to try to close the gap with them.
It will be the same with new people and simply be rules catered to those schools. More will join, would be the same thing as before until a gross overhaul is done.
Not if for example the SEC and B1G secede. Nobody else will be able to join them unless they agree to take them.

they really aren't. And usually aren't. There might be a few exceptions (I think Florida is one of them) but most of them are absolutely part of the university AND are funded with student fees....which is another absurd issue as you're just taking money from regular students to hand to other students...which is absurd.

i would be cool with them leaving.

UConn winning the real NCAA non-money laundering title would be just as sweet

No, it's really not. How do explain the NAIA? NJCAA? NCCAA? If it was a monopoly, it would have a Congressional approved anti-trust exemption, it would be the law of the land. It doesn't, hence the stream of lawsuits that has weakened the NCAA's authority member institutions granted the Association when it was it formed back in the early 1900s.

Not to mention players have other options

This is just a want the best of all worlds entitlement scenario

I can't think of any in the SEC that aren't profitable.

Now, many of the small frye run their programs at a loss. Many of them impose mandatory student fees that go to support their football programs.........

Keep trying to shake the SEC and B1G down for their TV money and they'll walk....and they'll take the large majority of the audience that watches college sports with them.

Yes, it really is. NAIA? You mean the organization for teeny tiny little pissant schools that don't even compete with the big boys?

NJCAA? You mean junior colleges?

NCCAA? You mean little Christian colleges that don't even compete in football and doesn't compete in the major sports?

We're talking about bigtime college athletics. For that, the NCAA is a monopoly. It being a monopoly is why it has repeatedly lost all the lawsuits filed against it. It would stand a much better chance in court if it were not the monopoly it currently is. "hey, don't like the terms our company offered? Then go to our competitors". When there's only one however......

Pretty straightforward, if it's a monopoly it has a Congressional approved anti-trust exemption. It doesn't. It's the lack of the exemption that makes the NCAA vulnerable to all the whack-a-mole anti-trust lawsuits. The NCAA has only the authority granted to them by their members, no legal authority backed by the weight of law.

No one challenged that for decades, at least not successfully/seriously, until Ed O'Bannon opened the floodgates. In that landmark ruling, the court found NCAA by-laws unlawful as they restricted free trade provisions in violation of federal anti-trust law.....because they aren't a monopoly. They are trying to gain an exemption, the goal of both SCORE and PCS Acts.

What??? They found the NCAA by laws unlawful because they restricted free trade in violation of federal anti trust law because they ARE a monopoly. If they were not a monopoly, they would not have violated anti trust law.

The SEC has already left the NCAA. They are cancelling inter-conference games left and right.

the courts are wrong on this one.

it's like saying that everyone who gets denied work by Facebook is a victim because FB makes more money than every small business in the US.
