For sure, but if it was illegal he should have arrested him on the spot.

Regardless, OBJ is a moron for slapping him. Why even do it? Absolutely nothing positive could come out of that.
The officer had no problem getting in their face telling them to quit smoking, doesn't seem like he was worried about a powder keg. The prudent thing to have done would have to pulled OBJ aside, informed him that he could arrest him for battery.
The fact that they went to a judge the day after, asked for a sexual battery charge, which wad denied, then redrafted it for a simple battery charge, IMO is chicken shit. This is the kind of shit that makes our police and justice system look like damn fools.
Shoulda just stuffed a couple of bucks in the cops pocket...like he did with some of the players.
