Or didn't see him until it was too late. Even a seasoned veteran race car driver isn't gonna have a lot of experience dodging pedestrians on a dirt track. It's not like that happens all the time.
I agree. But even then the driver would have a good defense because they would have no expectation of pedestrians walking on the interstate unlike a city street.
If a pedestrian is walking down the middle of the interstate and gets hit by a car we could debate all day and night whether the driver could have done more to avoid hitting him but the fact remains that the pedestrian never should have been there in the first place.

I don't mind if things get hot in the pits but a driver getting out of his car and walking towards a speeding dirt car trying to have a confrontation is an automatic finalist for the Darwin Award.
A car moving at 20mph can kill a pedestrian and even under caution they're moving a lot faster than that. What did that kid think he was gonna do? Punch the car off the track?
