Every other penalty that happens during a play (non dead ball) you either take the play and decline the penalty, or take the penalty and decline the play. Some will even let you do both, you can take the play and have the penalty still applied at the end of the play. I don't believe I've ever before seen a penalty applied from the middle of the play.
Again he fumbled during the play. If you apply a penalty at the end of the play it has to include the turnover. That's part of the play.
Personally, I've always thought the retarded part of the rule was that fumbles through the end zone result in a touchback. Had he fumbled it out of bounds at the one the result would have been 1st and goal at the 1/2 yard line. Essentially every fumble that goes out of bounds favors the offense, except that one...why the exception?
