Before announcing their name for their hockey club, the owners made an inadequate discovery effort. If they did discover the Army parachuting team and elected to ignore it, then, they are at fault for doing so. By using the name of the Army parachute team, they encourage false association among reasonable people. Doing so without prior agreement injures the Army parachute team by diluting their brand. Accordingly, the hockey team's legal position is weak.

I am baffled by the number of posters who dismiss proprietary precedence, favor the hockey usurpers, and dismiss the US Army's position. [Just because the hockey team is presently winning?] The US Army is bigger than the NHL. They've deep pockets. The hockey team would do well to mitigate the situation rather than continue to contest it.

Ask yourself, do you want to be the ones who disrespect the US Army? Do you think your fortunes will rise when the public views you as doing so?

As the post on page 1 indicates, there is nothing that says duplicate trademarks can't exist and there are currently several "Golden Knights" trademarks. Is the Army only going after the team because they are presently winning? Why aren't they going after the other trademark holders?

And no one is "disrespecting" anything, despite your obvious bias. Never heard the phrase "imitation is the sincerest form of flattery"?

Actually it's pretty strong as consumer confusion is the standard and seems unlikely in this case. First to file applies to patent law, but not trademark law. "Adequate discovery effort" is not a standard in this area of law. It is perfectly legal to file for and/or use a trademark already in use. It happens all the time.

I don't see how it disrespects the Army at all. Using the same name does not disrespect them, if anything mascots and team names are often an homage to the group they represent. And frankly, a lot of us have now heard of the army parachutists and might like to see them, something we would have never known existed were it not for the hockey team existing.

Also worth noting, the Golden Knights has never been registered as a trademark by the Army. That doesn't mean they don't have protection as you don't have to register to have protection.

If both parties were smart here, the hockey team could reach a promotional deal with the Army and it's a win-win for all sides.

Or they want free promotions or a themed uniform.

I don't like it. As you said, we all have gained knowledge on these parachuting Golden Knights because of the hockey team.

Knights has been copyrighted by the junior hockey team in London, Ontario. The name Knights would be fine for the States, but it wouldn't fly in Canada.

Trademark issues have been the cause of the delay in a team name, as the team’s owner Bill Foley and the league look to get beyond this hurdle.

The latest surrounds ‘The Knights,’ which has become an unlikely option, Foley told the Las Vegas Review Journal, because of the London Knights name in the Ontario Hockey League.

“The London Knights own the name in Canada and to acquire the name from London is not economically feasible,” said Foley, adding there should be “clarity” on the name issue in the next 30 days. “In the U.S., ‘Knights’ are fine. But we can’t use it in Canada.”
